The Bailout Shortfalls
03:19pm 01/10/2008
What are some reasons that the bailout is bad for our economy?

This is not a partisan issue. Both Republican and Democrat leaders are supporting this bill. Call your representative and tell them to oppose the bailout now.

Fat cats on Wall Street who have raked in billions for years are now extorting in effect $2,000 to $5,000 from every American family to make up for their own nonfeasance, malfeasance, greed, and just plain stupidity.

Wall Street, of course, wants the public to believe that this "deal" is too complex for the American people to understand. That's nonsense.

This is YOUR money going to Wallstreet head honchos who are walking away with literally MILLIONS in federal money for having run their respective companies into the ground while their subordinates tricked citizens into homes they knew people couldn't afford .

When an individual consumer uses a new credit card to pay off astounding debt from an old credit card, it's akin to check kiting, which is is illegal. Apparently, though, when the government does it, it's billed as Serious Public Policy. That's what this supposedly prudent bailout bill would do: Force taxpayers to borrow $700 billion from foreign banks to pay off the bad debt of Wall Street banks. During a crisis that is aimed at preventing interest rates from skyrocketing, nobody has been able to explain how adding almost a trillion dollars to the interest rate-exacerbating national debt would do anything other than undermine the plan's underlying objective. Worse, the U.S. Treasury Department itself admits that the $700 billion number is "not based on any particular data point" - that is, they created it out of thin air because "We just wanted to choose a really large number." Slapping that amount of money onto the national credit card when our government can't even justify the amount is beyond absurd - it is insane.

Further, the money isn't necessarily “borrowed”. It is created out of thin air which in turns makes the money you receive in your paycheck worth less and less. Think of it this way, if there is one whole pie and you receive an inch of it for your work, that inch has a value. Now lets say someone just creates more pie and gives it away. Your one inch of pie is now less scarce and as such is now worth less. This is fine when the economy is working as it should and is creating more value which needs to be accounted for in money but when value is disappearing, the last thing we need to do is create more debt to cover it. This will drive up the cost of already expensive food and fuel.

As mentioned above, the Treasury Department admits it has absolutely no factual basis for requesting $700 billion - an amount equivalent to about 5 percent of our entire economy. Additionally, the Washington Post reports that "Banks throughout the United States carried on with the business of making loans yesterday even as federal officials warned again that their industry is on the verge of collapse, suggesting that the overheated language on Capitol Hill may not reflect the reality on many Main Streets." Indeed, "many smaller banks said they were actually benefiting from the problems on Wall Street" and "even some of the nation's largest banks, which have pushed hard for a federal bailout, deny that the current situation is forcing them to reduce lending."

When people say that the credit crunch will cause a freeze in loans which would then destabilize the economy, one must wonder what they are talking about. Do they mean Chase can no longer lend GEC money? If so, what are we afraid of? Americans have always been resilient and if it does anything, this should help shake things up and allow us to shed the artificially inflated corporations that currently dominate many industries. This would allow many new (and in turn, more efficient!) companies to sprout up in their place. Competition = good as it results in more consumer options, greater efficiency and an overall healthier economy. Corporate welfare = bad as it helps to create a culture of corruption that prevents us from bettering our structure as it compares to other nations and their industry (capacity to effectively compete on a global scale). Of course Wallstreet doesn't care if this results in the collapse of our economy as they will have already swindled us out of a tidy 700 billion but you, the every day citizen with kids to put through school, should care!

We bailed out the airlines so that they could cut pay across the board by 30% while CEOs received multi-million dollar bonuses for “cleaning things up”. Now imagine that on a national scale. Fortune 500 companies have had record low pay increases over the last year while also sporting record high increases in executive bonuses. These banks own huge stakes in many of these super corporations. The banks are the shareholders (owners) and as so, are your boss.

So, think about it this way, they cut your raise down to 3% this past year, huh? Don't worry about it, they'll take that back in the form of inflation/taxes to cover their own bailout.

Ten Reasons this deal stinks of corruption:

Lack of accountability or transparency, resulting in a "blank check" of up to $1 trillion. Section 8 of the Draft Proposal for Bailout Plan2 reads, "Decisions by the Secretary pursuant to the authority of this Act are non-reviewable and committed to agency discretion... "

That means that the American people can never review and will never know how the $1 trillion was spent.

Lack of legal recourse for inappropriate use of $1 trillion in funds. Section 8 of the Draft Proposal for Bailout Plan3 concludes, "... and may not be reviewed by any court of law or any administrative agency."

That means that no matter how they spend the $1 trillion, they can't be sued or otherwise held liable for it. Even if the funds are used fraudulently or for any improper or unrelated purpose.

Lack of specific or objective criteria to determine who should be bailed out, which could result in cronyism, fraud, favoritism based on political affiliation or other misuse of taxpayers' funds.

Recipients of bailout funds are determined solely by the Treasury Secretary. There are no financial benchmarks, nor prohibitions of giving funds to related parties or based on partisan or other discriminatory factors. There are also no prohibitions of kickbacks.

Lack of specific valuation criteria for "illiquid assets" acquired by the federal government, which would result in over payments to institutions who made or purchased the bad investments.

The bailout plan is silent on what price the Treasury Secretary must pay the financial services industry to bailout their bad mortgage loans. Will the Secretary pay fair market value (i.e. what the "illiquid asset" is worth today) or will he pay the premium value of what the bad loan used to be worth before the market dropped?

This is important because if the Secretary pays the higher premium price, then American taxpayers are automatically stuck with losses that likely can never be recouped.

Normal business, and consumer, practice is to pay for an asset what it's actually worth on that day (i.e. fair market value). Princeton economist Paul Krugman describes "having taxpayers pay premium prices for lousy assets" as "in effect throwing taxpayers’ money at the financial world."

Lack of plan, budget or staff to oversee and account for this massive new Treasury Department function, which will inevitably cause a significant expansion in federal government bureaucracy.

This would be a massive undertaking on an unprecedented scale, and would cost billions of dollars in new federal government bureaucracy needs.... costs that would be passed on (coincidentally?) to the next administration and ultimately (in the form of government debt) to our children.

And yet, Section 76 of the bailout plan gives unlimited powers to the Treasury Secretary: "Any funds expended for actions authorized by this Act, including the payment of administrative expenses, shall be deemed appropriated at the time of such expenditure."

Lack of reform or regulation of, or any measure control over, institutions bailed out. Incredibly, the bailout plan requires no changes in the failed practices of the financial services industry.

Economist Robert Reich is spot-on when he writes that as a bailout condition, Wall Street firms must "agree to comply with new regulations over disclosure, capital requirements, conflicts of interest, and market manipulation.

The regulations would "emerge in ninety days from a bi-partisan working group, to be convened immediately. After all, inadequate regulation and lack of oversight got us into this mess." Is this in the bill to be passed by congress? No. These massive corporations can just go on screwing the American taxpayer.

Lack of restrictions on salaries, bonuses, stock options or any other compensation for executives bailed out. Treasury Secretary Henry Paulson, former chairman of Goldman Sachs, one of the world's largest investment banking firms, regards limits on compensation of Wall Street executives as a "poison pill."

The bailout plan proposal is silent on limits on salaries, bonuses, stock options or any financial penalties of any kinds for executives of firms bailed out by taxpayers.... despite that fact that top investment firm executives each take home millions annually.

For a glaring example, look at the $2.5 Billion Bonus for Lehman's New York staff.

In essence, Wall Street executives are protected by the bailout plan, while "Main Street" Americans take 100% of the fiscal responsibility for the executives' bad decisions.

Lack of punitive measures for institutions or executives bailed out. Likewise, the proposal for the bailout is entirely silent on punitive measures or penalties for either the firms bailed out or or the executives of those firms.

Lack of any homeowner protections or any for individual investors. No protections of any kind are given to homeowners whose mortgages may be foisted on the federal government. In fact, the proposal for the bailout plan gives the Treasury Department several incentives to accelerate foreclosure on homes to generate more cash for Treasury Department use.

Lack of any plan to reimburse taxpayers (the federal government), and lack of any plan to recoup taxpayer losses on these bad loans from future profits of institutions that made these bad loans.

At best, taxpayers will see only partial repayment of bad mortgage loans bought by the Treasury Department for two reasons: 1. The Treasury Department plans to pay premium prices to the bailed out banks, and 2. Under the Section 7 "... the Secretary may use the proceeds of the sale of any securities issued... including (for) the payment of administrative expenses."

At worst, of course, Americans taxpayers will see no repayment at all.

Bottom line: The Treasury Department plans to spend proceeds from the sale of foreclosed homes, and they aren't accountable to anyone for how they spend those funds, no matter how inappropriate or even fraudulent the expenditures.

In summary, under the Draft Proposal for Bailout Plan 11, the biggest institutions in the financial services industries would be protected from their losses and the executives would be shielded from any negative consequences.

U.S. taxpayers carry the burden (i.e. own) of up to $1 trillion or more of "illiquid assets," for which there is no plan or budget to collect the "assets" in order to reimburse taxpayers. This is the equivalent of a new tax on every U.S. household of from $2,000 to $5,000. What could you do with that much money? Buy a new computer for your kid? Pay off a credit card?

Meanwhile, those bailed out suffer no financial consequences and retain all present and future profits. And the brokers, realtors, and investment bankers keep all their rich profits and commissions from these loans gone bad.

P.S. - By the way, foreign banks and investors will be allowed to receive billion-dollar handouts. A large chunk of this $700 billion is going to be given directly to Chinese and Middle Eastern banks. There is NO guarantee of ever seeing that money again.

Not as in, “we are going to take 3000 dollars of your money and give them to poor children/disaster relief funds/struggling people of the world.” More like, “We aren't just giving your money to American rich. We are going toss some to our foreign rich friends too.”

Please stand up and contact your representative. The Wallstreet bullies have them in a corner. If you had to choose slavery under the fist of multinational banks and corporations or a terrible economy in which major institutions fall to make way for new and inherently better ones, which would you pick?
