{grins} My esteemed colleage in law school says that by violating the agreement, they are, in fact, committing a form of fraud. And since the site probably logs people's IP addresses and such, there's evidenciary material to back that up. Hence, the "actionable position."

The TOS are there for a reason. If you lie to gain an account then you have broken the TOS. Simple as that, in my opinion. As it says in the TOS: "Failure to comply with these TOS may result in account revocation."

The admins/site owners are being extremely lenient in allowing the EA accounts to continue. But they are in a tricky position, as it can be argued that the TOS always said 'Over 18', yet they allowed EA accounts to be created and kept by 'Under 18's'. Free Users were always going to think that isn't fair, as the TOS haven't been consistently followed by the site admins/owners.

I believe that all underage accounts would need to be revoked to show a consistent stance on the TOS. There are many other journalling sites available and the majority of users [under and over 18] have accounts on at least some of them.

That's why I suggested that specific titles or account designations be created for those 18- individuals who provide essential services to the site.

Actually, there is no IP logging other than the option to log IPs on comments in your journal(s). Either way, I don't think the admins are willing to start suspending the EAs for the same reason we let them stay before - there'd be way too many requests to handle. I'll discuss it with them, though.

Perhaps suspending underage EA accounts could be allowed. Personally, if someone is under 18 (free or EA) and seems mature, then I'm probably not going to report them (and I'm the "queen bitch" of the mature crowd here). I think that's the way most people on over18 feel as well; it's not the underagers we object to, it's the immature people.

As to the support volunteers, a special title or account type might be in order, to protect them if you do choose to suspend EAs. Free users will never be reconciled to the fact that EAs are allowed to stay while they can't, espcially if they have friends already here who have recommened the site to them.
